Agreeing to these terms

These terms are an agreement between you and Oddware ("we", "us") about your use of Gizmo at gizmo.oddware.xyz. By creating an account or using Gizmo, you agree to them and to our Privacy Policy. If you don't agree, please don't use Gizmo.

Accounts

• You must be an adult (18 or the age of majority where you live) to create an account. Accounts are for personal, family use.
• You may let children in your care use Gizmo with your account. You are responsible for that use and for deciding whether Gizmo is right for your child.
• Give us accurate details, keep your sign-in to yourself, and tell us if you think someone else has used your account.

What Gizmo is, and isn't

Gizmo is an AI companion. Its words, voice and pictures are made by AI as it goes, and they can be wrong, odd or unexpected. We work hard to keep Gizmo safe and kind for kids, but we can't promise it will never say something unsuitable. Gizmo is not a substitute for a parent, teacher, doctor, therapist or emergency service, and it doesn't give professional advice. Please stay involved in how your child uses it, and tell us at parkjundk@gmail.com if Gizmo ever says something it shouldn't.

Subscriptions and billing

• Plans. Talking to Gizmo needs a subscription, monthly or yearly, at the price shown when you subscribe. Prices may include or add tax depending on where you live.
• Payments. Checkout, payments and receipts are handled by Whop, and Whop's terms also apply to your purchase. We never see your card number.
• Automatic renewal. Your subscription renews automatically at the end of each month or year, and you'll be charged the then-current price, until you cancel.
• Gizmo's battery. Each subscription includes a generous amount of use, shown as Gizmo's battery, which refills regularly. If the battery runs out, Gizmo rests until it refills.
• Price changes. If we change the price, we'll tell you before it applies to your next renewal, so you can cancel first if you like.

Cancelling and refunds

You can cancel anytime from your Whop account. Cancelling stops the next renewal, and you keep Gizmo until the end of the period you've paid for. Payments are non-refundable, including for partly used periods, except where the law requires otherwise. If something has gone wrong, write to parkjundk@gmail.com and we'll do our best to make it right.

Use Gizmo kindly

Please don't:

• use Gizmo to break the law or to harm, bully or exploit anyone, especially a child;
• try to make Gizmo produce harmful, sexual, violent or hateful content;
• attack, overload, scrape or try to get around Gizmo's security or limits;
• copy, resell, reverse engineer or build a competing product from Gizmo;
• share your account outside your household.

Your content and ours

What you and your child say, type and show to Gizmo stays yours. You let us use it only to run Gizmo for you, as our Privacy Policy describes. You may keep and share the pictures Gizmo makes for your family for personal, non-commercial use. Everything else (the app, Gizmo himself, his world, characters and artwork) belongs to Oddware, and these terms give you a personal right to use it, not ownership of it.

Changes to Gizmo and these terms

Gizmo is new and will keep changing. We may add, change or remove features, and the service may sometimes be unavailable. If we update these terms, we'll change the date at the top and tell you about significant changes before they apply. Using Gizmo after that means you accept the new terms.

Ending

You can stop using Gizmo, cancel your subscription and ask us to delete your account at any time. We may suspend or close an account that breaks these terms or puts a child at risk. If we stop offering Gizmo altogether, we'll give you notice first.

No warranty

Gizmo is provided "as is" and "as available". To the extent the law allows, we don't promise it will be uninterrupted, error-free or suitable for any particular purpose.

Limits on our liability

To the extent the law allows, Oddware isn't liable for indirect, incidental or consequential losses, and our total liability to you for anything relating to Gizmo is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer where you live.

Disputes

If you have a problem, please write to parkjundk@gmail.com first. Most things can be sorted out quickly. If we can't resolve it together, either of us can take it to the courts where you live.

Everything else

These terms and the Privacy Policy are the whole agreement between us about Gizmo. If part of them turns out to be unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You can't transfer these terms to someone else; we may transfer them if Oddware or Gizmo changes hands.
